Terms and Conditions for Photo & Video Services
These Terms and Conditions ("Agreement") govern the provision of photo and video services ("Services") by John Patterson, trading as Intuitive Action Media Ltd ("Photographer/Videographer" or "Intuitive Action Media Ltd") to the Client ("Client"). By booking services, the Client agrees to the following:
1. Copyright & Ownership
All photographs, videos, and related media created under this agreement are the sole copyright of John Patterson, trading as Intuitive Action Media Ltd. No ownership rights are transferred to the Client unless expressly stated in a written agreement signed by both parties.
2. Client Usage Rights
Upon full payment, the Client is granted a perpetual, non-exclusive, royalty-free license to use the delivered images and videos for their own business promotion. This includes use across digital platforms (websites, social media, advertising) and print materials.
Content may not be resold, sublicensed, or distributed to third parties for profit without prior written consent from John Patterson.
3. Booking, Payment & Scope
- A non-refundable deposit of 50% of the total project fee is required to secure the booking.
- The remaining balance is due upon completion of the services, prior to the final delivery of media.
- Any additional work, add-ons, or changes to the original scope must be agreed upon and paid for in advance through a separate agreement.
4. Travel, Locations & Additional Costs
All travel expenses, location fees, accommodation, permits, and any related costs necessary to fulfil the project are to be covered by the Client, as agreed prior to booking.
5. Cancellations & Rescheduling
Should the Client wish to cancel or reschedule, this must be communicated in writing. Such changes may incur additional charges, determined at the discretion of Intuitive Action Media Ltd.
6. Liability
Intuitive Action Media Ltd will take all reasonable care in the production, backup, and delivery of services. In the unlikely event of unforeseen circumstances beyond our control — such as equipment failure, data loss, travel disruption (e.g., train failure), severe illness, or other force majeure events — Intuitive Action Media Ltd will offer a reshoot free of charge at the earliest mutually convenient date.
This applies solely to genuine circumstances preventing the successful delivery of the agreed services. Beyond this, liability is limited to the refund of any payments received. No further compensation or damages shall be claimable.
7. Model & Property Releases
The Client is responsible for obtaining all necessary permissions, consents, and releases for individuals and properties featured in the photo and video content.
8. Promotion & Portfolio Use
Intuitive Action Media Ltd reserves the right to use selected images and videos for marketing and portfolio purposes, including but not limited to website, social media, and promotional materials, unless the Client objects in writing.
9. Amendments
These Terms & Conditions may only be amended through a written agreement signed by both parties.
